No. 39099/2017 which was filed for restoration of Cr. Appeal (SJ) No. 530/2017 which stood dismissed for non prosecution vide order dated 23.08.2017 and Cr. Appeal (SJ) No. 530/2017 stood dismissed on account of non compliance of per emptory order dated 08.04.2017.

However, Considering the submissions made on behalf of petitioner, Cr. Misc. No. 39099/2017 is directed to be restored to its original status, on account thereof, Cr. Misc. No. 55161/2017 is allowed.
