The petitioner seeks bail in Ekchari P.S. Case No. 35 of 2018, registered for the offence under Section 25(1-b)a/26/35 of the Arms Act.

It is submitted on behalf of petitioner that petitioner has been made accused in this case on the basis of confessional statement of co-accused Akhilesh Yadav, who was apprehended on spot alongwith other co-accused. It is further submitted that no arms and ammunition have been recovered from the possession of the petitioner. Only material, which has come against this petitioner, is that place of recovery i.e. Basa, as per co-accused Akhilesh Yadav, belongs to this petitioner, but in paragraph - 10 of the bail petition, it has been specifically stated that said Basa does not belong to this petitioner. Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed.
