JUSTICE SANJAY KUMAR ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sultanganj P.S. Case No. 16 of 2017 instituted for the offences punishable under Sections 147, 148, 149, 120-B, 324, 448, 427, 342 of the Indian Penal Code and Sections 3(a) and (b) of the Explosive Substance Act.

It is alleged that on the date of occurrence, 12 named and 100 unknown persons came and hurled bomb on his house. The allegation is omnibus against the F.I.R. named accused persons. There is a counter version from the side of these

No.39623 of 2017 (3) dt.17-10-2017 2/2 petitioners that it was the informant and his men, who assaulted petitioners' brother, namely, Gopi Kumar and others for which Sultanganj P.S. Case No. 18 of 2017 was registered against the informant and his men. There is also a police case against these petitioners vide Sultanganj P.S. Case No. 20 of 2017. There is nothing specific allegation against these petitioners. The allegation appears omnibus against these petitioners. There is bona fide land dispute between the parties.

The learned A.P.P. for the State, on the other hand, opposed the submission.

Considering the nature of allegation, facts and circumstances of the case, the anticipatory bail prayer is allowed. The petitioners, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class cum Additional Munshif, Patna City, Patna, in connection with Sultanganj P.S. Case No. 16 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
