This application, for grant of anticipatory bail, arises out of Samastipur Muffasil P.S. Case No. 322/2016, disclosing offences under Sections 341, 323, 384, 379, 504 and 34 of the Indian Penal Code.

It is alleged against the petitioner that he used to ask the informant to pay extortion money (Rangdari) which was protested by the informant. The informant claims to be an agent of Swayam Krishi Sangan, a non-governmental organization, Mohanpur branch engaged in activities like engaged in the business of chitfund company. Learned counsel for the petitioner submits that as a

No.43262 of 2017 (2) dt.21-09-2017 2/2 matter of fact, the petitioner and others had been objecting, as the informant indulged in collecting money from the innocent people, by giving false assurances of repayment of double the amount deposited. It is submitted that petitioner shall cooperate the police in course of investigation and will present himself before the police and the Court as and when required.

Considering the above submission, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Vth, Samastipur in connection with Samastipur Muffasil P.S. Case No. 322/2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
