The petitioners seek bail in a case registered under Sections 147, 448, 323, 307, 379, 504 of the Indian Penal Code. Later on Section 302 of I.P.C. has been added. Prosecution case, in short, is that the accused persons including the petitioners assaulted the informant by means of spade on his head. When his brother Raghunandan Paswan and son Ramakant Paswan came to save him, the accused persons also assaulted them and caused head injury and also caused fracture injury to Chandni Devi. They also assaulted Jagdish Paswan and caused head injury and they took away Rs.20,000/-

It has been submitted on behalf of the petitioners that the petitioners are in custody since 16.03.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made. No specific overt act is alleged against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss. Simmi Kujur, Judicial Magistrate, 1st class, Khagaria in connection with Beldaur P.S. case No.37 of 2019.
