The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 504, 506, 308, 379 and 147 of the Indian Penal Code. It is a case of assaulting to the informant's husband by means of brash fighter by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there are three injuries of swelling on leg wrist and right knee which opined grievous in nature and the injury report shows that the injuries have not sustained on the vital part of the body of the victim. He further submits that the injury report is not consonance with the fact of the prosecution case.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 205 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
