The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on receiving information about the petitioner and one another being involved in manufacture of liquor, it is stated that a raid was conducted. While the accused persons managed to escape, various articles and mahua etc was recovered.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any material has been recovered from his possession. The cause of his false implication is his antecedents. He is in custody since 10.7.2021.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, the petitioner not having been arrested at the spot nor having any concern with the place of recovery together with the petitioner having remained in custody for about 10 months, the Court directs the petitioner to be enlarged on bail in connection with Hisua P.S. Case no. 403 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II-cum-Special Judge, Nawada.
