The petitioner apprehends his arrest in Parsa P.S. Case No. 172 of 2016 registered under Sections 409, 420 and 120B of the Indian Penal Code.
The informant, who is present Chairman of Primary Agriculture Cooperative Society, Aneyay, Saran, alleged that the petitioner was Chairman of the earlier Primary Agriculture Cooperative Society till the year 2014, but, he did not hand over the charge to the informant about the financial matter of the Primary Agriculture Cooperative Society.
The learned counsel for the petitioner submits that he has already handed over the charge to the new incumbent and the remaining records are kept in the office of the Primary Agriculture Cooperative Society, Aneyay, Saran. The petitioner is ready to cooperate during the audit and, if any, amount is found missing, the petitioner is ready to deposit the same. Till date no audit was done nor any amount is said to have been misappropriated by the petitioner.
Considering the facts, aforesaid, the petitioner, in the
Patna High Court Cr.Misc. No.42428 of 2017 (3) dt.09-11-2017 2/2 event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Parsa P.S. Case No. 172 of 2016 to the satisfaction of Mr. Rakesh Kumar Yadav, Judicial Magistrate, 1st Class, Saran at Chapra, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
