Petitioner is apprehending his arrest in connection with Complaint Case No.1082 of 2017 , registered for offences punishable under Sections 323, 498A, 506/34 of the Indian Penal Code.

As per the complaint case petitioner is husband of the complainant. There is allegation of demand of motorcycle and also threatening to solemnize another marriage . It appears that O.P.no.2 has received the notice but nobody appears on behalf of the O.P.no.2.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and the cognizance has been taken only under Section 498A of the IPC and he is still ready to keep her with dignity and care but the O.P.no.2 is

Patna High Court CR. MISC. No.44306 of 2019(4) dt.05-11-2019 2/2 not ready to reside with the petitioner as he has instruction that she has solemnized another marriage even in her statement also she has denied to reside with the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Begusarai in connection with Complaint Case No.1082 of 2017 dated 24.6.2017 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
