Mr.Umesh Lal Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-07-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Obra P.S. Case No. 61 of 2021 registered for offence punishable under sections 420, 467, 468, 474, 120(B) of the Indian Penal Code.

As per allegation, the police got an information that some persons were extorting money from the drivers of some

Patna High Court CR. MISC. No.58145 of 2021(2) dt.05-07-2022 2/3 vehicles after providing them forged certificate of pollution control. Co-accused Nitesh Kumar @ Nepali Yadav was arrested and he disclosed the name of the present petitioners as well as Biru @ Rajnish Kumar.

The learned counsel for the petitioners has submitted that there is nothing against the petitioners except confessional statement of co-accused. He has submitted further that on similar footing, Biru @ Rajnish Kumar was granted anticipatory bail by the learned Sessions Judge-VIII, Aurangabad in ABP 636 of 2021. He has also submitted that even Nitesh Kumar @ Nepali Yadav has been granted bail by Additional Sessions Judge-IX on 10.06.2021.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar (Aurangabad) in connection with Obra P.S. Case No. 61 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the
