JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Mahila P.S. Case no. 52 of 2018, registered under Sections 341, 342, 323, 325, 504 and 498(A)/34 of the Indian Penal Code and Section 3/4 of the D.P. Act.

Sri Shanti Bhushan Singh, Advocate appearing for petitioner along with petitioner and Sri Manish Kumar Singh, Advocate appearing on behalf of O.P.No.2/informant along with informant are present.

Learned counsel for the petitioner and O.P. No.2 /informant submits that after filing the present petition, the petitioner and O.P. No. 2 are leading their conjugal life and informant/O.P. No.2 is residing with her husband (petitioner)

Patna High Court CR. MISC. No.46304 of 2019(5) dt.15-10-2019 2/2 and there is no grievance in between them. The O.P. No.2/informant, herself, submits that she has no objection in allowing the pre-arrest bail of her husband (Petitioner). Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in connection with Mahila P.S. Case No. 52 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
