JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged against the petitioner that he shot at the informant, as a result of which, the informant received gunshot injury on his right thigh.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence

Patna High Court CR. MISC. No.48407 of 2023(3) dt.19-09-2023 2/2 of 13.04.2020, F.I.R was registered on 17.04.2020. The injury of the informant is not on the vital part of the body. There is no accusation of repeating the blow. The petitioner is languishing in custody since 22.03.2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Supplementary Mansi P.S. Case No. 116 of 2020 (G.R. No. 1128/2020).
