The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 396 of the Indian Penal Code and 17 of Criminal Law Amendment Act.

The accusation is of rifles, carbine and other articles from the police station and setting the police station on fire when several persons killed. The name of the petitioner sprang up on confession of co-accused.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and earlier

Patna High Court Cr.Misc. No.34475 of 2014 (03) dt.13-05-2015 2/2 the bail application of the petitioner was rejected with observation at present vide Cr. Misc. No. 1530 of 2013 only on the ground that the petitioner has criminal antecedent.

Supplementary affidavit has been filed to the effect that the petitioner is accused in five cases, but in one case he has been acquitted and in rest of the cases he has been granted bail. Similarly situated accused Deven Tuddu has been granted bail vide Cr. Misc. No. 17419 of 2012.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge Vth, Lakhisarai in connection with Sessions Trial No. 24 of 2013 arising out of Jhajha Rail P.S. Case No. 15 of 2008. Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
