Petitioner seeks regular bail in a case registered for the offence punishable under Section 406, 420, 506, 34 of the Indian Penal Code.

As per the prosecution case, an agreement was made by four persons, including this petitioner, with the informant for execution of the land for that Rs. 18,20,000/- was paid to them. It is alleged that Rs. 6,00,000/- was given to this petitioner. It is submitted that petitioner is ready to return the amount of Rs. Six lakhs, which was given to this petitioner, and the first installment of Rs. One Lakh would be paid to the informant at the time of furnishing bail bond and rest amount of Rs. Five Lakh shall be paid in four installments in the gap of

Patna High Court CR. MISC. No.57452 of 2021(3) dt.07-02-2022 2/2 three months. Petitioner is in custody since 03.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Patna, in connection with Digha PS case No.460/2019, subject to condition that the first installment of Rs. One Lakh would be paid to the informant by this petitioner at the time of furnishing bail bond and rest amount of Rs. Five lakhs shall be paid in four installments in the gap of three months. If the petitioner fulfills the aforesaid condition, provisional bail granted to the petitioner shall be confirmed by the court below and if he fails to fulfill the aforesaid condition, the provisional bail granted to the petitioner shall be cancelled by the court below itself.
