The petitioner seeks bail in Bairganiya P.S. Case No. 64 of 2005, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. 12 persons were apprehended. One Gauri Shankar Jha is said to have confessed his guilt and disclosed the name of the petitioner. There was cross-firing in between the police and the extremists. Except confessional statement of co-accused, the investigating officer did not collect any tangible evidence against the petitioner. The petitioner is in jail since 18.06.2014.
