JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Shri Mukesh Kumar Singh, learned A.P.P. for the State. The petitioner seeks bail in connection with Supaul (Lokha O.P.) P.S. Case No. 593 of 2020 instituted for the offences under Sections 25(1-b)A, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 21.06.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that informant alleges that the joint house of the petitioner Suman Kumar Singh and Ajay Kumar Singh was raided and arms, as detailed in the F.I.R., were recovered apart from liquor, codeine, ganja, motorcycle, cash etc.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would

No.56430 of 2021(2) dt.23-02-2022 2/2 manifest that the informant himself has stated that the house was a joint family property as such the learned counsel submits that petitioner was not aware who had kept the arms along with other articles in the house. Learned counsel further submits that as far as recovery of liquor and narcotics are concerned, for that a separate case has been instituted and further, the raid was conducted behind the back of the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.06.2021, charge-sheet has been submitted in the case and the search was made in absence of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul (Lokha O.P.) P.S. Case No. 593 of 2020 with a condition that one of the bailor shall be the mother of the petitioner namely Vevi Devi @ Bebi Devi.
