The petitioner seeks bail in a case registered for the offence under Section 394 of the Indian Penal Code. As per the prosecution case, this petitioner alongwith three other miscreants riding on three motorcycles surrounded the informant and assaulted him with the butt of pistol and thereafter, snatching his motorcycle fled away. The petitioner was identified on the spot.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and by profession, he is a motorcycle mechanic and earns his livelihood. No incriminating article has been recovered from his possession. Though, petitioner has got criminal antecedent, but in most of the cases, his name has come in confessional statement.

Patna High Court CR. MISC. No.58133 of 2021(3) dt.24-03-2022 2/2 Petitioner is in custody since 18.08.2020. Chargesheet has already been submitted.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has been duly identified by the informant and he has got criminal antecedent and he is accused in sixteen more cases.

Considering the aforesaid facts and circumstances as well as criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
