The petitioner seeks bail in connection with Sonpur Rail P.S. Case No. 158 of 2024 instituted for the offence under Sections 316(4), 336(3), 336(4), 338 & 340(2) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case, in short, is that on 05.12.2024, Sonpur Rail Police apprehended Deepak Kumar Tiwari and Saksham Shrivastava near Hajipur while they were trying to flee. They were accused of forging railway joining letters, running a training centre, and were found in possession of mobiles, ATM cards, PAN cards, and other items. 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.50980 of 2025(2) dt.11-08-2025 2/3 that the petitioner is in custody since 13-12-2024. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused, namely, Sanjay Kumar and Sudhir Kumar. Nothing has been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that save and except confessional statement of co-accused, there is no material against the petitioner. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, manner of petitioner's implication and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
