JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gamahriya P.S. Case No. 133 of 2018, registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506, 385/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against several accused persons, including the petitioner is of demanding extortion and also there is allegation against the petitioner of firing but the same did not hit anybody and further allegation is of assault by rod by accused persons and further it appears that petitioner is accused in six other cases.

Submission of learned counsel for the petitioner is that FIR itself shows that firing did not hit anybody and

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of the submissions made above and, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
