The petitioner seeks bail in Raniyatalab (Rani Talab) P.S. Case No. 10 of 2020, registered for the offence under Section 302 and 34 of the Indian Penal Code.

As per the F.I.R., some unknown miscreants committed the murder of son of the informant due to dispute in the business of sand.

It is submitted on behalf of petitioner that name of petitioner transpired during course of investigation at a belated stage in the statement of uncle of the deceased, who suspected that this petitioner alongwith other four co-accused persons have committed the murder of his nephew. It is further submitted that save and except suspicion, there is no material against this

Patna High Court CR. MISC. No.57471 of 2021(2) dt.01-02-2022 2/2 petitioner to show his complicity in the aforesaid crime. Petitioner is in custody since 17.02.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Danapur (Patna) / concerned court in connection with Raniyatalab (Rani Talab) P.S. Case No. 10 of 2020.
