2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation in the first information report is that seven F.I.R. named accused persons fired indiscriminately upon the informant's brother, who, subsequently, died during course of treatment.

4. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. and the specific allegation of firing is on the seven named persons. The name of the petitioner has transpired in this case on the confessional statement of co-accused, Ritik Kumar @ Sujit Kumar and the said Ritik Kumar @ Sujit Kumar has already been granted regular bail by a coordinate Bench of this Court

Patna High Court CR. MISC. No.46126 of 2025(2) dt.05-08-2025 2/3 vide order dated 27.09.2024 passed in Cr. Misc. No.36994 of 2024. One co-accused, Amit Kumar has already been granted regular bail by this Court vide order dated 28.05.2025 passed in Cr. Misc. No.35381 of 2025. It is further submitted that one coaccused, Shubham @ Reyansh Kumar has also been granted regular bail by a coordinate Bench of this Court vide order dated 24.04.2024 passed in Cr. Misc. No.28403 of 2024 and all those orders have been annexed as Annexure-2 series to this application. The petitioner has one criminal antecedent and has been languishing in custody since 02.04.2025.

5. Learned APP for the State opposed the bail petition.

Taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bihta P.S. Case No.930 of 2023, subject to the conditions that : (i) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his close family member.

(ii) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
