JUSTICE SHIVAJI PANDEY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Singhiya P.S. Case No.70 of 2017, registered for the offence punishable under Sections 341, 323, 384, 307 and 504/34 of the Indian Penal Code. Allegation has been made that while the informant was passing through the house of Ganga Shankar Choudhary, all the petitioners surrounded him and forcibly taken L.T.I. of the informant on the plane stamp paper. When protest was made, the petitioners were assaulted him by farsa.

In the petition, it has been mentioned that the

Patna High Court Cr.Misc. No.40445 of 2017 (2) dt.19-09-2017 2/2 petitioners have no criminal history, but the learned counsel for the informant has produced the case diary of Singhiya P.S. Case No.04 of 2012, showing that two persons, namely, Sitam Ram and Parshuram Choudhary-petitioner no.3 have been made accused in that case.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected.

The affidavit has been shown by Panchmukhi Devi, who is a female of 53 years. This Court though is inclined to give direction for lodging the criminal case against Panchmukhi Devi, but looking to the fact that she is a lady, this Court is not giving direction for lodging the criminal case.
