JUSTICE MIHIR KUMAR JHA ORAL ORDER 09-01-2015 After some argument learned counsel for the petitioner in respect of the following prayer in this writ application: "That the petitioner is filing this writ application for quashing an order issued by the District Manager, Bihar State Food and Civil Supplies Corporation Limited, Bihar, Patna contained in letter no. 2360 dated 12.7.2008 by which a Bank guarantee of Rs.5 lacs of the petitioner has been forfeited.

The petitioner was selected for appointment of transporting cum handling agent of the B.S.F.C. and was ordered to execute an agreement but failed to execute the agreement which amounts to violation of the terms and conditions of the notice inviting tender. Therefore order of forfeiture of Bank guarantee of Rs.5 lacs was passed."
