JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-08-2021 Heard Mr. Ajit Kumar, learned Advocate for the petitioner and Mr. Surendra Prasad Singh, learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Sheikhpura (Hathiyawan O.P.) P.S. Case No. 373 of 2020 dated 01.09.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379, 427 and 504 of the Indian Penal Code. It has been alleged in the FIR that the petitioner and others assaulted the members of the prosecution party. There is a counter version of the occurrence also. The injured persons of the subject FIR have received simple injuries whereas the petitioner has received grievous injuries. The reason for falsely implicating the petitioner in this case is an old land and boundary dispute. The petitioner is an agnate of the
Patna High Court CR. MISC. No.1624 of 2021(3) dt.12-08-2021 2/2 informant. The petitioner was earlier made accused in one case about which reference has been given in paragraph-3 of the bail petition but in that case he is on bail.
Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Hathiyawan O.P.) P.S. Case No. 373 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
