This is the second attempt on behalf of the petitioner for grant of bail in connection with Pakriwarama (Dhamaul) P.S. Case No. 486 of 2022 registered for the offence under sections 363, 366-A, 376-C, 370-A of the Indian Penal Code, under sections 4, 5 and 6 of the Human Trafficking Act, under sections 4 and 17 of the POCSO Act and under sections 9 and 10 of the Child Marriage Prohibition Act. 3.

It is alleged that a minor girl was kidnapped by the accused persons and was sent to Rajasthan where she was sold to the co-accused for marriage.

It has been submitted by learned counsel for the petitioner that in the present case charge has been framed and no witness has been examined in the trial. 5.

Considering the aforesaid facts and also the law laid down by the Hon'ble Supreme Court in the case of Pinki vs. State of Uttar Pradesh reported as 2025 SCC OnLine SC 781, I am not inclined to grant bail to the petitioner. Accordingly, this bail application is dismissed. 6.

Since it is a case of human trafficking, the trial court is directed to conclude the trial of the petitioner and other accused persons within six months from today in view of the decision of the Hon'ble Supreme Court in the case of Pinki vs. State of Uttar Pradesh (supra).

The Superintendent of Police, Nawada is directed to ensure the attendance of the witnesses in the trial. 8.
