The petitioner seeks his bail in a case registered under Sections 302 and other sections of the IPC.

The petitioner and other co-accused persons are alleged to have taken the deceased but thereafter the deceased became traceless. It is submitted that the dead body of the deceased was found after two weeks of the occurrence. There is no eye witness of the occurrence. Even all the witnesses have stated that the petitioner and other co-accused persons were last seen with the deceased but the dead body was recovered in decomposed condition after two weeks. The petitioner is in jail since 22.7.2014.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh in connection with Mokama P.S. Case No.39 of 2014.
