Petitioner seeks bail in Ahiyapur P.S. Case No. 291 of 2014 registered under Sections 394 IPC against unknown. The informant has alleged that the accused persons robbed of his motorcycle and belongings worth Rs. 34,000/-. Contention of the petitioner is that in course of investigation, nothing tangible has been found. One of the co-accused namely Md. Irshad @ Ataur Rahman made confessional statement in which the name of the petitioner figured. Md. Irshad @ Ataur Rahman has since been released on bail by this Court vide order dated 03.02.2015 passed in Cr. Misc. No. 4543 of 2015. Petitioner is languishing in custody since 02.06.2014. There is another case

Patna High Court Cr.Misc. No.50273 of 2014 (5) dt.30-06-2015 2/2 pending against the petitioner in which he has been released on bail.

Considering the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S. Case No. 291 of 2014 with following conditions:

(i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
