The petitioners apprehend their arrest in connection with Kochadhaman P.S. Case No. 149 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that petitioners have no concern neither with the alleged motorcycle from where the alleged illicit liquor has been recovered nor with the seized illicit liquor, as is evident from supplementary affidavit.

No.56813 of 2021(4) dt.09-05-2022 2/2 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II, Special Judge (Excise), Kishanganj in connection with Kochadhaman P.S. Case No. 149 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
