JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 05-12-2018 The present writ petition has been filed for a direction to the respondents to open the financial part of the tender submitted by the petitioner in pursuance of the advertisement published in daily newspaper Hindustan dated 23.10.2013 for appointment of transporting and handling agent in the Revenue District of Motihari when the documentary part of the tender was opened and all the requirements were found valid; and for connected reliefs.

2. As none appeared on behalf of the petitioner the matter was passed over for a few cases. However, on repeat call the petitioner was again not represented.

3. Learned counsel for the respondents submits that

Patna High Court CWJC No.23759 of 2013 dt.05-12-2018 2/2 the writ petition has now become infructuous by efflux of time as the tender was floated for a period of three years, which has since elapsed.

4. Having regard to the stand of the respondents, which stands supported from the perusal of the tender notice enclosed as Annexure-1, the writ petition stands dismissed.
