This PIL was suo motu registered on the basis of news published in the newspaper dated 18.12.2020 in which it was reported that a judicial officer while he was travelling in his official car at Hilsa, District, Nalanda, Bihar, his car was attacked by hooligans on the road and windscreen was damaged. Some newspapers also reported about firing taking place at the place of occurrence.
The learned Advocate General was directed to submit
Patna High Court CWJC No.9635 of 2020 dt.12-07-2021 2/3 action taken report on behalf of Director General of Police and pursuant thereto, an affidavit was filed by the Director General of Police, Bihar, Patna in which it was stated that Superintendent of Police, Nalanda had made a detailed enquiry in respect of incident and submitted his report according to which, on 17.12.2020, at around 4:30 p.m., while learned Additional District and Sessions Judge-I, posted at Hilsa Civil Court was returning to his residence, when the vehicle was pushed by two persons riding on motorcycle and, thereafter, they assaulted the driver of the car and 2-3 more persons came from the nearby market and broke the front glass of the car and on the statement of driver Sanjay Prasad, FIR was registered vide Hilsa P.S. Case No.656 of 2020 dated 17.12.
2020 under Sections 341, 323, 504, 506, 427, 307/34 of IPC and one SIT was constituted by the SP, Nalanda for investigation of the case and miscreants were identified and apprehended and sent to jail and on completion of investigation, police has already submitted the charge-sheet against the accused persons.

As far as the incident of firing is concerned, it is not related with the present incident and it was a separate incident of robbery which took place at a short interval and at a short distance for which Hilsa P.S. Case No.657 of 2020 dated 17.12.2020 has been instituted against unknown persons. In view of affidavit filed on behalf of Director General of Police, Bihar, there is no need to continue this proceeding any further and is, accordingly, consigned.
