====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

3. As per prosecution case, daughter of informant was married with co-accused Mantu Kumar in the month of October 2019 and thereafter, all the accused persons including this petitioner subjected her to cruelty and torture for demand of dowry and due to non-fulfillment of the same, she was killed.

4. It is submitted that petitioner is cousin brother of the husband of deceased. There is general and omnibus allegation against the petitioner. Petitioner is separate in mess and property and he is not concerned with the family affairs of the deceased. Moreover, thrust of accusation is against husband

Patna High Court CR. MISC. No.53137 of 2024(2) dt.20-09-2024 2/2 of the deceased who is already in custody. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa Nalanda in connection with Telhara P. S. Case No. 60 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
