2. The petitioner who apprehends arrest in connection with Paharpur P.S. Case No. 423/2023 lodged on 19/10/2023, for the offences punishable under sections 341, 342, 323, 324, 325, 307, 379, 504, 506, 34 of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution, the F.I.R. has been lodged against seven named accused persons alleging therein that all the accused persons were trying to make medh on the field of the informant which was protested by the informant. Thereafter, all the accused persons started abusing and threatened to kill the
Patna High Court CR. MISC. No.47821 of 2026(2) dt.22-07-2026 2/3 informant. It is further alleged that Arjun Kumar is stated to have assaulted the informant with a 'kudal' on his head due to which he became injured.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that there is one criminal antecedent in which he is on bail. He further submits that Annexure-P/2 is the final form which has been submitted by the Police after investigation finding the case untrue against the petitioner. He also submits that even after filing the final form, cognizance has been taken. He also submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed.
5. Learned Counsel for the informant opposes the prayer for bail and submits that the anticipatory bail application of Petitioner No. 2 in Criminal Misc. No. 38132 of 2026 has been allowed and the anticipatory bail of Petitioner No. 1 has been rejected by the Co-ordinate Bench of this Court vide order dated 16.06.2026.
6. In response, thereof learned Counsel for the petitioner submits that bail application of co-accused Jagdam Thakur has been rejected. It is further submitted that the chargesheet has already been submitted against the remaining accused
Patna High Court CR. MISC. No.47821 of 2026(2) dt.22-07-2026 3/3 persons and the case of the petitioner stands on a different footing.
6. Learned APP for the State opposes the prayer for bail but fairly submits that though the police has submitted charge-sheet on conclusion of investigation, but finding the case against the petitioner untrue.
7. In the facts and circumstances of the case, let the above-named petitioner be released on bail, in the event of his arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of 30,000/- (Rupees ₹ Thirty Thousand only), as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the learned Additional Chief Judicial Magistrate-IX, East Champaran, in connection with the aforementioned case, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
