Mr. Satpal Singh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-05-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR clearly depicts that allegation of commission of fire-arm injury to the deceased is against co-accused Ashok Rai and Manoj Rai. The doctor has found two fire-arm injuries consistent with the prosecution allegation in the FIR. Allegation against the petitioner is that he was involved in conspiracy. Learned counsel for the informant opposed the prayer for bail.

Considering the nature of allegation against the petitioner and completion of investigation, let the petitioner,

Patna High Court CR. MISC. No.3244 of 2021(3) dt.24-05-2021 2/2 above named, who is in custody since 17.09.2020, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nayagaon P.S. Case No.132 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
