2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 304 and 34 of the Indian Penal Code .

3. As per the prosecution case , due to negligence of this petitioner and other co-accused persons the wife of informant died in the Child Care Hospital, which is said to be running in the house of this petitioner.

4. Learned counsel for the petitioner submits that petitioner has been made accused in this case merely because he happens to be owner of the house in which alleged Child Care Clinic is running. Petitioner has got nothing to do with the alleged nursing home . He is neither the doctor nor staff of the

Patna High Court CR. MISC. No.51859 of 2024(2) dt.21-08-2024 2/2 aforesaid clinic . The nursing home is owned by Smt. Renu Kumari ( wife of the petitioner) and she has rented the premises to co-accused Sinut Kumar on agreement.

5. Learned counsel for the State opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM - 1st Danapur District Patna in connection with Danapur P.S. case No. 357 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
