Learned counsel for the appellant submits that the present appeal has been filed against the order dated 01.05.2024 passed by learned Exclusive Special Judge, SC/ST (POA) Act, Patna in connection with Special Case No. 392 of 2020 arising out of Sultanganj P.S. Case No. 221 of 2020 whereby discharge petition filed by the appellant has been dismissed and he has been directed to physically appear on 17.05.2024 for framing of charge. Learned counsel further submits that now, stage of the case has been changed and hence, he intends to withdraw the present appeal with liberty to raise his grievance at appropriate stage.
