The petitioner apprehends his arrest in Narpatganj P.S. Case No. 398 of 2016 under Section 436 and other sections of the Indian Penal Code.
The petitioner is alleged to have ordered other accused persons to set ablaze the dwelling house of the informant. It is, further, alleged that the petitioner put the wife on the ground and tried to push her in the burning house.
The learned counsel for the petitioner submits that the informant is own uncle of the petitioner. There is no specific allegation against the petitioner, but, it appears that on the order of the petitioner other accused persons set ablaze the dwelling house of the informant on which all the house hold articles of the informant burnt to ashes.
Considering the allegation, made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail is rejected. If the petitioner surrenders in the Court below, the learned Court below shall consider the regular bail of the
Patna High Court Cr.Misc. No.43416 of 2017 (2) dt.19-09-2017 2/2 petitioner without being prejudiced of the order of this Court and if possible disposed off the petition on the same day. (Prabhat Kumar Jha, J) SA/- U √ T √
