JUSTICE SANJAY KUMAR ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and leaned Additional Public Prosecutor of the State.

The petitioner is apprehending his arrest in connection with Bidupur P.S.Case No. 156 of 2017 registered for offences punishable under Sections 147, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

It is alleged that all together seven persons assaulted the informant by the means of Lathi and Danda and in course of assault they snatched gold chain from his possession. The mother of the informant was also assaulted by the accused persons. It has been submitted that the informant and petitioner are resident of same place and the offence of assault had taken place due to quarrel between the children of two families. The

Learned Additional Public Prosecutor opposes the prayer of bail.

From perusal of Annexure-2, which is injury on the informant, it appears that he sustained a lacerated injury on his head and another injury caused is redness, pain and swelling around left eye. The allegation of assault is also omnibus. Considering the facts and the circumstances of the case, let the petitioner, above named, in the event of even of his arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each in connection with Bidupur P.S.Case No. 156 of 2017 to the satisfaction of learned Additional Chief Judicial MagistrateXIV, Vaishali at Hajipur, subject to the conditions laid down under Section 438 ( 2) Cr.P.C.
