The petitioner apprehends his arrest in connection with Supaul P.S. Case No. 716 of 2019 registered under Sections 420, 406, 467, 468, 471, 197 and 198 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that on

No.602 of 2021(5) dt.18-11-2021 2/3 perusal of the case diary, it appears that the agreement of construction of road from Maharaji Tola to Sanghi Tola BlockMarauna was executed between the petitioner and the informant (Executive Engineer). After execution of the agreement the work is being carried out by the petitioner and in fact, the petitioner has already completed the substantial work more than 90% of the total work and only meagre work is remaining. The petitioner has completed the work with full satisfaction of all concerned and there is absolutely no complain from any corner with regard to quality and quantity of the work. The petitioner has already been paid of R/A (Running on Account) bills for the work done after being fully satisfied by the respondents.

At the time of agreement, the validity of Bank Guarantee for an amount of Rs. 3,00,000/- (Rupees Three Lakhs) submitted at the time of tender as earnest money expired and thereafter, the petitioner replaced the same by way of fresh Bank Guarantee and this is not the allegation that the fresh Bgs is forged. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.602 of 2021(5) dt.18-11-2021 3/3 amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 716 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
