The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act and Section 414, 34 of the Indian Penal Code. Total 121 liters & 860 ml. of illicit foreign liquor have been recovered from the house and vehicles of the petitioner.

It is submitted on behalf of petitioner that petitioner has got criminal antecedent and he is accused in two more cases of similar nature and he is in custody since 08.08.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery and the fact that petitioner has got criminal antecedent of similar nature of cases,

No.58150 of 2021(2) dt.17-12-2021 2/2 the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kudhani (Turki O.P.) P.S. Case No. 748 of 2020, corresponding to G.R. No. 1517 of 2020, after framing of the charge.
