JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-06-2022 Heard learned counsel for the petitioners, learned counsel for the complainant and learned APP for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The case of the complainant is that the petitioners took Rs.1,00,000/- for execution of the sale deed but neither they executed sale deed nor returned the money.
Patna High Court CR. MISC. No.56923 of 2021(3) dt.22-06-2022 2/3 It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the complainant is known to petitioner no.1 took Rs.8 lakh in the October, 2018 for the business purpose and in return handed over two cheques of Rs.4 lakh and again on 21.06.2019 petitioner no.1 transferred Rs.1,50,000/- to Shashank Auto Private Limited as an advance payment for purchase of Scorpio Vehicle in the name of the father of complainant and for that sake complainant transferred Rs.1 lakh in the account of petitioner no.1 on 15.07.2019 and 19.07.2019 but as yet Rs.50,000/- has not been returned . Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Ms. Kanchan Yadav, Judicial Magistrate, Ist Class, Muzaffarpur/concerned Court in connection with Complaint Case No. 2484 of 2019, subject to
