The appellant seeks anticipatory bail in connection with A.B.P. No. 2046 of 2018 arising out of Ekma P.S.Case No. 105 of 2018, registered for offences punishable under Sections 341, 324, 323, 354 (b), 307/34 of the Indian Penal Code and under Sections 3 (2) (va)/3 (I) (w) SC/ST ACT.

Allegation against the appellant as per F.I.R. is that the appellant along with other three unknown persons tried to drag the informant in order to outrage her modesty and assaulted with dab on her neck, causing injuries.It is also alleged that the appellant is an accused in five cases also except the present case in which he is on bail.

Submission of the learned counsel for the appellant is that informant had taken a loan of Rs. 30,000/- from the mother of the appellant but she did not return the money and a false case has been lodged against the appellant. Heard learned Special P.P. who opposes the prayer

Patna High Court CR. APP (SJ) No.3750 of 2018 dt.16-01-2019 2/2 for bail on the ground that the injuries are grievous in nature. From perusal of the F.I.R. as well as the materials available on the record, I am not inclined to grant bail to the appellant and if the appellant surrender before the Court below and make prayer for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
