2. The petitioner has preferred this application for grant of regular bail in connection with Phulparas P.S. Case No. 373 of 2024 dated 11.09.2024 corresponding G.R. No. 1450 of 2024, S.T. No. 39 of 2025 registered for the offences punishable under Sections 329(4), 352, 109, 115(2), 76, 303(2), 351(3) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, it is alleged that the petitioner along with three unknown persons entered the room of the informant and started abusing and the petitioner assaulted on the head of the informant by means of sword due to which she got injured and blood started oozing out. Thereafter, the
Patna High Court CR. MISC. No.46627 of 2025(4) dt.13-08-2025 2/3 petitioner dragged her out from the room in an injured state and assaulted her with legs, fists and slaps. It is further alleged that the petitioner snatched golden chain from the neck of the informant. On halla, villagers came there and saved her life and brought to hospital for treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. Nothing has been recovered from the possession of the petitioner. It is further submitted that during the course of investigation, not a single witness has supported the case of the prosecution. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.09.2024.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner and submitted that the specific allegation of assaulting the informant is against the petitioner. It is further submitted that as per the injury report of the injured, the injury is stated to be grievous in nature caused by sharp edged substance.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.46627 of 2025(4) dt.13-08-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Phulparas P.S. Case No. 373 of 2024.
7. The application stands allowed.
