2. The petitioner is in custody in connection with Patahi P.S. Case No. 110 of 2023 for the offence under Section 392 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 24.05.2023.

4. One person was looted on the Highway and the F.I.R was registered with against unknown. The petitioner's name has come in the confessional statement of co-accused Ghultan Das.

5. Learned counsel for the petitioner has offered to pay Rs. 15,000/- to the informant to bear the loss without prejudice to his rights and without accepting his guilt.

6. In view of the aforesaid facts and period of custody,

No.48031 of 2023(2) dt.02-08-2023 2/2 the petitioner, named above, is directed to be released on bail on after completing nine months in judicial custody and after producing a Demand Draft of Rs. 15,000/- in the name of the informant on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, East Champaran at Motihari in connection with Patahi P.S. Case No. 110 of 2023.

7. If the Demand Draft is deposited in the court below, the same shall be released in favour of the informant by the court below.

8. The petitioner will visit Patahi Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
