The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 448, 325, 354, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act Allegation is allegation against the petitioner along with accused persons is of entering in the house of informant and accused person dragged the informant holding her hand in half naked position and also assaulted her by the danda. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. Patna High Court CR. MISC. No.3455 of 2021(2) dt.18-11-2021 2/2 Fua of the petitioner and the injury report shows that simple in nature. The occurrence took place on 07.07.2020 and FIR lodged on 12.07.2020 after lapse of five days and there is no explanation for such delay. The petitioner has got two criminal incidents, which is mentioned in para 3 of the bail application. Learned APP for the State vehemently opposed the prayer for bail of the petitioner.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram, in connection with Sasaram Town, P.S. Case No. 416/2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
