The petitioner is apprehending her arrest in Birpur P.S.Case No.41/17 for the offences under Sections 341, 323, 324, 307, 504 and 379/34 of the I.P.C.
Allegation as per written report is that this petitioner along with another co-accused assaulted the informant and his wife.
It has been submitted that the petitioner is own bhabhi of the informant and dispute is going on for fencing around the hand pump in the courtyard on account of which the present occurrence took place. It is further submitted that the injuries sustained by the informant and his wife are said to be simple in nature.
Learned A.P.P.opposed this petition.
Patna High Court Cr.Misc. No.37912 of 2017 (2) dt.11-08-2017 2/2 Petitioner and the informant are agnates for fencing court yard the occurrence took place and the injury report shows that the injuries are simple in nature.
Considering the nature of allegation, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.,1st, Bergusarai, in Birpur P.S. Case No.41/17 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
