The petitioner apprehends his arrest in connection with Naugachia P.S. Case No. 202 of 2014 instituted for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Rajesh Mandal the husband of the deceased Hemanti Devi alleged that his wife had gone for training along with Ashish Kumar Das @ Ashok Ravidas, but Ashish Kumar Das @ Ashok Ravidas informed him that his wife Hemanti Devi is missing in Naugachia market. The informant further alleged that after sometime the dead body of his wife was recovered and it appears that she was strangulated to death. The informant
Patna High Court Cr.Misc. No.39558 of 2017 (2) dt.21-08-2017 2/3 suspected that Ashish Kumar Das @ Ashok Ravidas with the help of Pramod Ravidas and Mahanth Ravidas strangulated his wife to death.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case merely on suspicion. He was neither seen with the deceased nor any incriminating material has come against the petitioner. During the course of investigation, similarly situated co-accused Mahanth Ravidas @ Mahant Kumar Ram has been allowed anticipatory bail on 30.01.2015 by one of the co-ordinate Bench of this Court in Criminal Miscellaneous No. 688 of 2015 and so, this petitioner also deserves anticipatory bail. The learned A.P.P. for the State opposed the submission.
Considering the omnibus allegation against the petitioner and the fact that similarly situated co-accused has been allowed anticipatory bail on 30.01.2015 in Criminal Miscellaneous No. 688 of 2015, the anticipatory bail prayer is also allowed. The petitioner, above named, in the event of arrest / surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned
