JUSTICE BIRENDRA KUMAR ORAL ORDER 19-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366/34 of the Indian Penal Code.

The allegation relates to abduction of the daughterin-law of the informant. The wife of the informant and the husband of the victim have stated before the police that, in fact, no one had seen any one taking away the victim, rather she had some affairs with the named person and she voluntarily went away. The victim is second wife of the son of the informant. Subsequently, a compromise petition has been filed in the case. Patna High Court Cr.Misc. No.59760 of 2018(3) dt.19-11-2018 2/2 Kushwaha has already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 08.10.2018 passed in Cr. Misc. No. 56816 of 2018, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Mohania Police Station Case No. 444 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
