JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-03-2018 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing of the order dated 25.01.2017 passed by the learned Additional Chief Judicial Magistrate-III, Nawada in Narhat P.S. Case No.178 of 2016 by which the prayer for release of the Bus bearing registration 2K-7305 has been refused on the ground that confiscation case has already been initiated against the petitioner. At the outset, it is brought to the notice of the court that in Confiscation Case No.81(M) of 2017 the Collector, Nawada, vide order dated 18.12.2017 has confiscated the afore-stated bus. The said order dated 18.12.2017 has not been challenged till date. Learned counsel for the petitioner submitted that in view
Patna High Court Cr.Misc. No.36745 of 2017 (2) dt.14-03-2018 2/2 of the subsequent development, he may be permitted to withdraw the present application in order to seek statutory remedy available in law against the afore-stated order dated 18.12.2017. Leave is granted.
