The petitioner apprehends his arrest in K. Nagar (Champanagar) P.S. Case No.342 of 2018 registered under Sections 147, 148, 341, 342, 353 and 504 of the Indian Penal Code.

The gist of the allegation that one person, who sustained injury, died during the course of treatment in Bhagalpur. The relatives of the deceased brought the dead body and blocked the road. The petitioner is alleged to have instigated the family members of the deceased to put hindrance. Learned counsel for the petitioner submits that the petitioner was dragged in the case only on the basis of suspicion but the petitioner has no manner of concern with the incident.

Patna High Court CR. MISC. No.43871 of 2019(2) dt.17-07-2019 2/2 The relatives of the deceased were protesting against road accident. It is submitted that there is no allegation of assault against the petitioner and the fact that all offences are bailable save and except section 353 of the IPC.

Having considered the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with K. Nagar (Champanagar) P.S. Case No.342 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
