2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 317(2), 305 (c) of the BNS.

3. The prosecution case, in short, is that the petitioner allegedly stole a bag from a train. It is further alleged that from the said bag, some used clothes and a mobile were recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the bag, in question, belongs to the petitioner himself and he has

It is submitted that though the petitioner is stated to have criminal antecedents of eight cases, he has not committed the present offence. Moreover, the petitioner is languishing in judicial custody since 24.04.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail stating that the petitioner has criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muzaffarpur Rail P.S. Case No. 97 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- X, Muzaffarpur with an observation that the petitioner shall not indulge in similar nature of case in the near future.
